How Do I Adopt My Stepchild in Florida?
Adopting a step-child is a joyful event, but you need to ensure that all the proper steps are taken to finalize the step-parent adoption properly. Chapter 63 of the Florida Statutes provides the procedures and steps for the step-parent adoption. The process is started by filing a Petition signed and verified and will need a judgment terminating parental rights, or, if the adoptee is an adult or a minor relative or a stepchild of the petitioner, the address, if known of any person whose consent to the adoption is required. If such person has not consented, the facts and circumstances to excuse the lack of consent to justify a termination of parental rights.
Petitions for the adoption of a step-child, a relative or an adult shall not require the filing of a separate judgment or separate proceeding terminating parenting rights pending adoption. The final judgment of adoption shall have the effect of terminating parental rights simultaneously with the granting of the decree of adoption. Within thirty (30) days after entry of a judgment of adoption a new birth record should be obtained. The adoption creates the relationship between the adopted person and the petitioner and all relatives of the petitioner that would have existed if the adopted person were a blood descendant of the petition born within wedlock.
